Course Management LLC — Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the website located at cmgolfco.com (the "Site") and any purchase made through it. The Site is owned and operated by Course Management LLC ("Course Management," "we," "us," or "our"), a limited liability company organized in the State of Oregon. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who We Are
Course Management LLC is a small business selling golf apparel and accessories, operated out of Portland, Oregon. You can reach us at coursemanagementgolfco@gmail.com with any questions about these Terms, an order, or our products.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order on the Site. By using the Site, you represent that you meet this requirement.
3. Products & Pricing
We make reasonable efforts to display our products, including colors and details, as accurately as possible, but we do not guarantee that your device's display will be perfectly accurate, especially for products that have been made by hand and intended to have variability. All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to limit quantities, refuse or cancel any order, and correct pricing or listing errors, including after an order has been placed, in which case we will notify you and issue a refund if payment was already collected.
4. Orders & Payment
When you place an order, you're making an offer to purchase the product(s) in your cart. We reserve the right to accept or decline any order for any reason, including suspected fraud, errors in pricing or product information, or issues with payment. Payment is processed securely through our third-party payment provider(s) at the time of purchase; we do not store your full payment card information.
5. Shipping
We currently ship within the United States only. Shipping timeframes are estimates, not guarantees, and we are not responsible for delays caused by carriers or events outside our control. Risk of loss and title for items purchased pass to you upon our delivery to the carrier.
6. Returns & Refunds
All sales are currently final, and we are not able to offer returns at this time, however exchanges are possible for other products or shop credit. If your order arrives damaged, defective, or incorrect, please contact us at coursemanagementgolfco@gmail.com within 10 days of delivery so we can make it right on a case-by-case basis. This policy may be updated in the future, and any changes will be reflected on this page.
7. Intellectual Property
All content on the Site, including but not limited to designs, logos, product artwork, photography, and text, is the property of Course Management LLC or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from this content without our prior written permission.
8. User Conduct
You agree not to use the Site for any unlawful purpose, to attempt to interfere with its normal operation, or to misuse any content, product images, or materials from the Site without permission.

10. Disclaimer of Warranties
The Site and all products are provided "as is" and "as available," without warranties of any kind, either express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or completely secure.
11. Limitation of Liability
To the fullest extent permitted by law, Course Management LLC and its owners shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of our products. Our total liability for any claim related to an order is limited to the amount you paid for that order.
12. Indemnification
You agree to indemnify and hold Course Management LLC and its owners harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Site.
13. Force Majeure
We are not responsible for delays or failures in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, severe weather, carrier disruptions, supply chain shortages, labor disputes, or other similar events.
14. Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Multnomah County, Oregon.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Course Management LLC regarding your use of the Site, and supersede any prior agreements or understandings, whether written or oral.
17. Changes to These Terms
We may update these Terms from time to time. The "Effective Date" above reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
